The first thing that I tell a potential client that has not applied for Social Security Disability or Supplemental Security Income is, "If you feel that you meet the qualifications for benefits, apply!" In order to apply, you can either (1) apply online at http://www.ssa.gov or (2) schedule a phone appointment with your local Social Security office and apply over the phone.

The unfortunate truth of the matter is most individuals are denied Social Security Disability and/or Supplemental Security Income after their initial application. This typically happens regardless of whether you have an attorney. After your first denial, you should consider hiring an attorney to help you protect your rights. Generally, you have 60 days from your date of denial to request the Social Security Administration reconsider their decision. Don't wait until the last minute. That said, you may decide you are comfortable proceeding forward on your own, and that's alright. However, it is crucial that you appropriately and timely file your request for reconsideration within the 60-day time period.

The necessity of this preparation period is why it is so important that, if you have been denied benefits after your request for reconsideration, you seek an attorney right away.
