Nursing Homes in Illinois should provide reasonable care to patients.
Long term care facilities and nursing homes need to provide reasonable and standardized care to patients, and the civil justice system is the key to ensuring that they do. Illinois passed The Nursing Home Care Act in 1979 to address concerns of poor, inadequate and degrading care of elderly patients in nursing homes and long- term care facilities. While this legislation was passed with honorable intentions in mind, and with the sincere desire to correct a dire situation, Illinois nursing homes and long-term care facilities continue to offer substandard care, in some instances. While Illinois continues to monitor nursing homes, and investigate their actions, the state cannot correct this concerning situation on its own.
The civil justice system in Illinois is designed to hold individuals and businesses accountable if they fail to conduct themselves in a reasonably safe manner and that failure causes injury to another. This fundamental principle will help correct the actions of nursing homes who provide substandard care to patients.
Nursing homes should appropriately assess patients, create a care plan that is specifically tailored to the individual needs of each patient, make sure that the care plan is followed, and change the care plan as needed throughout the care of the patient. If a nursing home fails to perform any of these actions, a patient might suffer from bed sores, pressure ulcers, falls, physical abuse, malnutrition, dehydration, sepsis, medical errors, choking, and sometimes even death.
If you or your loved one has suffered from a nursing home's failure to provide reasonable and standardized care, you should consider hiring an attorney to investigate the circumstances that caused the injury. If a nursing home is held accountable for its failure to provide reasonable and standardized care, that nursing home will be less likely to repeat the same error when caring for future patients.
Nursing homes and long term-care facilities are businesses. Businesses look to change when their bottom line necessitates change. In this regard, trial attorneys and the state of Illinois are working towards the same goal. We are ensuring that these businesses, that we entrust with the care of our elderly, provide that care in a reasonable and standardized fashion. This goal will only be achieved if those who are suffering are given a voice.
